OVERVIEW

These Terms of Service govern your use of the BMADINC website and the purchase of products from us. By accessing our website or placing an order you agree to be bound by these terms in full. If you do not agree with any part of these terms please do not use our website.

BMADINC is a women's streetwear brand based in Bangkok, Thailand. Throughout these terms "we", "us", and "our" refer to BMADINC. "You" and "your" refer to the person accessing or using our website and services.

1. ELIGIBILITY

By using our website you confirm that you are at least 18 years of age or are accessing the site under the supervision of a parent or legal guardian who agrees to these terms. We reserve the right to refuse service to anyone at any time at our discretion.

2. ACCOUNT REGISTRATION

You may be required to create an account to access certain features of our website. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update that information if it changes. We reserve the right to suspend or terminate accounts that contain false information or that we reasonably believe have been compromised.

3. PRODUCTS AND AVAILABILITY

All products on our website are subject to availability. We operate a limited drop model — products are released in finite quantities and are not guaranteed to be restocked once sold out. We reserve the right to discontinue any product at any time without notice.

Product images on our website are as accurate as we can make them. However colors and textures may appear slightly different on screen depending on your device's display settings. We do not guarantee that what you see on screen is a perfect representation of the physical product.

We reserve the right to limit quantities purchased per customer per drop to ensure fair access for all buyers.

4. PRICING

All prices are displayed in the currency shown at checkout. Prices are subject to change without notice. The price you pay is the price displayed at the time you complete your order. We are not obligated to honor pricing errors and reserve the right to cancel orders placed at an incorrect price, notifying you promptly and issuing a full refund if payment has already been taken.

Prices displayed on our website do not include customs duties, import taxes, or local handling fees that may be applied by your country's customs authority. These costs are your sole responsibility. Please refer to our Refund Policy for further detail on international orders.

5. ORDERS AND CONTRACT

Placing an order on our website constitutes an offer to purchase. A binding contract between you and BMADINC is formed only when we send you an order confirmation email. We reserve the right to refuse or cancel any order at our discretion, including but not limited to situations where a product is out of stock, where we suspect fraudulent activity, or where a pricing error has occurred.

If we cancel your order after payment has been taken we will issue a full refund to your original payment method within 5–7 business days.

Order confirmations are sent to the email address provided at checkout. It is your responsibility to ensure this address is correct. We are not responsible for missed confirmations due to incorrect email addresses or spam filters.

6. PAYMENT

We accept payment via the methods displayed at checkout. All transactions are processed securely through our payment provider. By placing an order you confirm that you are the authorized holder of the payment method used or have the explicit permission of the authorized holder.

Payment is taken in full at the time of order. We do not offer payment plans or installment options unless explicitly stated at checkout.

We reserve the right to verify the identity of the cardholder for fraud prevention purposes and may request additional information before processing your order. Failure to provide requested verification may result in your order being cancelled and refunded.

7. SHIPPING AND DELIVERY

We ship worldwide from Bangkok, Thailand. Delivery timeframes are estimates and are not guaranteed. We are not responsible for delays caused by customs processing, courier delays, national holidays, adverse weather conditions, or any other circumstances outside our control.

A tracking number will be provided for all orders once dispatched. It is your responsibility to monitor your shipment and ensure someone is available to receive it at the address provided.

We are not responsible for orders that are lost, delayed, or undeliverable due to an incorrect or incomplete shipping address provided at checkout. Please review your address carefully before completing your order.

8. INTELLECTUAL PROPERTY

All content on the BMADINC website including but not limited to text, graphics, logos, images, product designs, brand names, and the overall visual identity is the exclusive intellectual property of BMADINC and is protected under applicable copyright and trademark law.

You may not reproduce, copy, distribute, modify, sell, or use any content from our website for commercial purposes without our express written permission. Personal, non-commercial use is permitted provided it does not misrepresent or damage the BMADINC brand.

Our brand name, logo, and product graphics may not be used in any way that implies endorsement, affiliation, or partnership with BMADINC without our prior written consent.

You retain ownership of any content you create. By tagging or submitting content to us you confirm that you own the rights to that content and that it does not infringe the rights of any third party.

Our total liability to you for any claim arising from your use of our website or purchase of our products shall not exceed the amount you paid for the order giving rise to the claim.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.

If informal resolution is not possible disputes shall be subject to the exclusive jurisdiction of the courts of Bangkok, Thailand, unless mandatory consumer protection laws in your country of residence provide otherwise. Where local law grants you the right to bring proceedings in your own jurisdiction that right is not affected by these terms.

Customers in the European Union retain the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr for resolving disputes related to online purchases.

18. SEVERABILITY

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable under applicable law that provision shall be deemed severable from these terms and shall not affect the validity and enforceability of the remaining provisions.

19. ENTIRE AGREEMENT

These Terms of Service together with our Privacy Policy and Refund Policy constitute the entire agreement between you and BMADINC regarding your use of our website and supersede any prior agreements or understandings, whether written or oral.
